Terms & Conditions of Vehicle Rental

Best Borneo Holiday & Rent A Car

1. Eligibility Requirements

To rent a vehicle, the renter must:

  • Be at least 21 years old.
  • Hold a valid driving licence recognized in Malaysia.
  • Present a valid identification document (NRIC, Passport, or equivalent).
  • Hold a valid credit card, debit card, or approved payment method.

The company reserves the right to refuse rental at its sole discretion.

2. Reservation & Payment

  • Reservations are subject to vehicle availability.
  • A booking deposit may be required to secure a reservation.
  • Full rental payment must be completed before vehicle collection unless otherwise agreed.
  • Prices are quoted in Malaysian Ringgit (MYR).

3. Security Deposit

A refundable security deposit may be required.

The deposit may be used to cover:

  • Vehicle damage
  • Traffic fines
  • Parking violations
  • Fuel shortages
  • Toll charges
  • Cleaning charges
  • Missing accessories or equipment

Unused deposit balances will be refunded within 7–21 business days after vehicle inspection.

4. Vehicle Collection

At collection, the renter shall:

  • Inspect the vehicle condition.
  • Verify fuel level.
  • Report any pre-existing damage.
  • Sign the Rental Agreement.

Failure to report visible damage before departure shall be deemed acceptance of the vehicle's condition.

5. Authorized Drivers

Only drivers listed in the Rental Agreement are permitted to operate the vehicle.

The renter remains fully responsible for any actions of additional authorized drivers.

6. Permitted Use

The vehicle shall not be used:

  • For racing or speed testing.
  • For off-road driving unless specifically authorized.
  • For illegal activities.
  • To carry dangerous goods.
  • To transport passengers for hire without written approval.
  • By any unauthorized driver.

Violation of this section may void insurance coverage.

7. Fuel Policy

The vehicle must be returned with the same fuel level provided at collection.

Fuel shortages will be charged at prevailing rates plus administrative fees.

8. Vehicle Return

The vehicle must be returned:

  • At the agreed location.
  • On the agreed date and time.
  • In substantially the same condition as received.

Late returns may incur additional rental charges.

9. Early Return

No refund will be provided for unused rental days resulting from early return unless approved by management.

10. Breakdown & Accident Procedure

In the event of an accident, theft, or breakdown:

The renter must:

  1. Contact Best Borneo Holiday & Rent A Car immediately.
  2. Make a police report within 24 hours where required.
  3. Not admit liability to third parties.
  4. Cooperate fully with insurance investigations.

Failure to comply may result in full liability for damages.

11. Insurance & Liability

Basic insurance coverage may be included subject to policy terms.

The renter remains liable for:

  • Insurance excess amounts.
  • Damage caused by negligence.
  • Damage caused by unauthorized drivers.
  • Damage resulting from prohibited use.

Insurance coverage may become void if rental terms are breached.

All vehicles are covered by basic motor insurance in accordance with Malaysian regulations and subject to the terms, conditions, exclusions, and limitations imposed by the insurer.

In the event of an accident, theft, fire, vandalism, or damage to the vehicle, the renter shall remain liable for the applicable insurance excess amount.

The applicable excess amount shall be determined based on the rented vehicle category and stated in the Rental Agreement.

Circumstances Where Excess Applies

The renter shall be liable for the insurance excess in cases including but not limited to:

  • Collision or accident damage.
  • Single-vehicle accidents.
  • Damage caused by negligence.
  • Third-party claims arising from the renter's fault.
  • Theft of the vehicle.
  • Vandalism.
  • Windscreen damage (unless separately covered).

Full Liability Situations

The renter may be held fully liable for all repair costs, loss of use, towing charges, and third-party claims where:

  • The driver is under the influence of alcohol or drugs.
  • An unauthorized driver operates the vehicle.
  • A police report is not lodged when required.
  • The renter breaches the Rental Agreement.
  • The vehicle is used for illegal activities.
  • The vehicle is driven recklessly or off-road without approval.
  • Damage is caused by flooding, river crossing, seawater exposure, or intentional misconduct.

Optional Excess Reduction

Where available, the renter may purchase an additional Collision Damage Waiver (CDW) or Excess Reduction Cover to reduce their financial liability.

The purchase of such protection does not eliminate liability for negligence, prohibited use, or breaches of this Agreement

12. Traffic Summons & Tolls

The renter is responsible for:

  • Parking fines
  • Traffic offences
  • Speeding tickets
  • Toll charges

Any administrative fees incurred by the company in processing these charges may be passed to the renter.

13. Cancellation & Refund Policy

More than 7 days before rental

Full refund less transaction fees.

3–7 days before rental

50% refund.

Less than 72 hours before rental

No refund.

No-show

No refund.

14. Limitation of Liability

Best Borneo Holiday & Rent A Car shall not be liable for:

  • Loss of personal belongings.
  • Missed flights or travel arrangements.
  • Business losses.
  • Indirect or consequential damages.

15. Force Majeure

The company shall not be liable for delays or inability to provide vehicles due to:

  • Natural disasters
  • Severe weather
  • Government restrictions
  • Public emergencies
  • Events beyond reasonable control

16. Governing Law

These Terms shall be governed by the laws of Malaysia.

Any disputes shall be subject to the jurisdiction of the courts of Sabah, Malaysia.
