This Legal Notice governs the use of all services, vehicles, websites, booking platforms, social media pages, and communications operated by Best Borneo Holiday & Rent A Car ("Company", "we", "us", or "our").
By booking, renting, driving, or using any vehicle supplied by the Company, you agree to comply with all applicable terms, conditions, policies, and laws.
Vehicle Rental Agreement
All rentals are subject to a signed Rental Agreement between the Company and the renter.
The renter acknowledges that:

Driver Responsibility
The renter and any authorized driver shall:
- Comply with all Malaysian traffic laws and regulations.
- Operate the vehicle safely and responsibly.
- Ensure the vehicle is not driven under the influence of alcohol, drugs, or any substance that impairs driving ability.
- Immediately report accidents, theft, breakdowns, or damage to the Company.
Any fines, penalties, summonses, toll charges, or legal liabilities incurred during the rental period remain the responsibility of the renter.
Limitation of Liability
To the fullest extent permitted by law, Best Borneo Holiday & Rent A Car shall not be liable for:
- Loss, theft, or damage to personal belongings left in the vehicle.
- Delays, missed flights, missed appointments, or interrupted travel plans.
- Indirect, incidental, or consequential damages.
- Losses resulting from road closures, traffic conditions, weather events, natural disasters, or circumstances beyond our reasonable control.
The renter assumes all risks associated with the use of the rented vehicle.
Vehicle Condition and Inspection
Vehicles are provided in roadworthy condition and are inspected prior to delivery.
The renter agrees to:
- Inspect the vehicle upon collection.
- Report any pre-existing damage before driving away.
- Return the vehicle in substantially the same condition, excluding normal wear and tear.
Failure to report damage at the time of collection may result in the renter being held responsible for any subsequently discovered damage.
Insurance and Damage Liability
Insurance coverage, where applicable, is subject to the terms and exclusions of the insurer.
The renter may remain liable for:
- Insurance excess amounts.
- Damage resulting from negligence.
- Damage caused by unauthorized drivers.
- Damage caused by misuse, reckless driving, or prohibited activities.

Insurance protection may be void where the renter breaches any rental terms or applicable laws.
Prohibited Use
The vehicle shall not be used:

- For racing, competitions, or speed testing.
- For driver training.
- For transporting hazardous materials.
- By persons not authorized under the rental agreement.
- Outside approved operating areas without prior written approval.
Any violation may result in immediate termination of the rental agreement and additional liability.
Data Protection and Privacy
Personal information collected during the booking and rental process will be used solely for:
- Reservation management.
- Vehicle rental administration.
- Payment processing.
- Insurance and legal compliance.
- Customer support.
The Company will handle personal information in accordance with applicable Malaysian privacy and data protection laws.
Intellectual Property
All trademarks, logos, business names, photographs, website content, and marketing materials belonging to Best Borneo Holiday & Rent A Car remain the exclusive property of the Company and may not be reproduced without written permission.
Governing Law
This Legal Notice and all rental transactions shall be governed by the laws of Malaysia.
Any disputes arising from the use of our services shall be subject to the exclusive jurisdiction of the courts of Sabah, Malaysia.
